Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Slava application ("Slava," "the App," "our Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and The Atlas Elevated Company ("we," "us," "our"), a company registered in Manitoba, Canada.

2. Description of Service

Slava is a faith companion application designed for Serbian Orthodox Christians. The App provides daily feasts and saints calendar, an Orthodox fasting calendar, a Slava (patron saint celebration) guide, and an AI-powered faith Q&A feature called "Ask Why."

The App is available on iOS and Android platforms. Certain features require a Slava Plus subscription.

3. Beta Service

Slava is currently in a closed beta testing phase. During the beta period, you acknowledge and agree that:

☦ Features may change, be added, or be removed without prior notice

☦ Bugs, errors, and service interruptions may occur

☦ The App is provided on an "as available" basis with no guarantees of uptime or availability

☦ We may limit the number of beta testers at our sole discretion

Your participation in the beta does not guarantee continued access to the Service after the beta period ends.

4. Account Creation & Eligibility

To use Slava, you must create an account. You agree to provide accurate, current, and complete information during registration.

☦ You must be at least 13 years old to use the App (16 years old in the European Union)

☦ You may only create one account per person

☦ You are responsible for maintaining the security of your account credentials

☦ You must notify us immediately of any unauthorized use of your account

5. Subscription Terms

Slava offers a free tier and a premium subscription called Slava Plus.

☦ Slava Plus Annual: $29.99 USD per year

☦ Slava Plus Monthly: $4.99 USD per month

Subscriptions are managed through the Apple App Store or Google Play Store, depending on your device platform.

6. Free Trial

Slava Plus includes a 14-day free trial for new subscribers. At the end of the trial period, your subscription will automatically renew at the applicable rate unless cancelled.

To cancel your free trial or subscription, manage your subscription through your device's App Store or Google Play Store settings. Cancellation must be completed at least 24 hours before the end of the current billing period.

7. App Store & Google Play Billing

All subscription billing is handled by Apple (for iOS users) or Google (for Android users). The Atlas Elevated Company does not process payments directly.

☦ Refund requests must be directed to Apple or Google per their respective refund policies

☦ Prices may vary by region and are displayed in your local currency at the time of purchase

8. Prohibited Uses

You agree not to:

☦ Use the App for any unlawful purpose or in violation of any applicable laws

☦ Reverse engineer, decompile, or disassemble any part of the App

☦ Scrape, harvest, or collect data from the App by automated means

☦ Use the App to harass, abuse, or harm others

☦ Use the App for any commercial purpose without our written consent

☦ Impersonate clergy, church officials, or other religious authorities

☦ Attempt to gain unauthorized access to the App's systems or other users' accounts

9. AI Feature Disclaimer (Ask Why)

The Ask Why feature is powered by Anthropic's Claude AI. You acknowledge and agree that:

☦ Ask Why provides informational content only and is NOT a substitute for clergy guidance, confession, or spiritual direction

☦ AI-generated responses may contain inaccuracies or errors

☦ You should always consult qualified clergy or spiritual advisors for matters of faith, doctrine, and spiritual practice

☦ We do not guarantee the theological accuracy or completeness of AI-generated responses

10. Faith Data Sensitivity

We recognize that your faith data is deeply personal and sensitive. Information about your religious beliefs, spiritual practices, and faith journey is handled in accordance with GDPR Article 9 standards for special category data.

11. Intellectual Property

All content, design, branding, logos, and software comprising the Slava application are the intellectual property of The Atlas Elevated Company and are protected by applicable copyright, trademark, and other intellectual property laws.

Liturgical texts, saint commemorations, and traditional Orthodox prayers included in the App are in the public domain. Our arrangement, presentation, and commentary on such texts remain our intellectual property.

12. User Content

You retain ownership of any personal content you create within the App, including reflections, notes, and journal entries.

By using the App, you grant The Atlas Elevated Company a limited, non-exclusive license to process and store your content solely for the purpose of operating and improving the Service. We will never share your personal content with third parties except as described in our Privacy Policy.

13. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ATLAS ELEVATED COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Winnipeg, Manitoba, Canada.

15. Changes to Terms & Contact

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or in-app notification before the changes take effect.

Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
